Candidate Privacy Notice

athGADLANG is committed to protecting the personal data of individuals who apply for employment, register on our Talent Platform, are referred to us, or are considered for recruitment or placement opportunities.

This notice explains what personal data we collect, how and why we use it, who we may share it with, how long we retain it, and your rights under applicable data protection laws, including the UAE Federal Decree-Law No. 45 of 2021 concerning the Protection of Personal Data and, where applicable, the Kingdom of Saudi Arabia Personal Data Protection Law and the EU General Data Protection Regulation.

1. Who we are

GADLANG Management Consultants, operating under the athGADLANG name, is responsible for processing personal data submitted through this Careers portal.

Where you apply for a position with another athGADLANG entity or for a role with one of our clients, that entity or client may separately process your personal data for its recruitment and employment purposes.

2. Personal data we collect

Depending on the role and stage of the recruitment process, we may collect:

  • your name, email address, telephone number, address and location;
  • your CV or résumé and the information contained in it;
  • your employment history, current role and employer, professional experience, education, qualifications, certifications and professional memberships;
  • information about your skills, languages, technology or ERP experience and other professional capabilities;
  • your salary expectations, availability and notice period;
  • your nationality, residency, work-authorisation and visa status, where relevant to your eligibility to work;
  • your answers to role-specific questions;
  • interview notes, assessment results and recruitment-related correspondence;
  • references and information provided by former employers, educational institutions, professional bodies or recruitment agencies;
  • publicly available professional information, including professional networking profiles and professional registers;
  • copies of identity, immigration, academic or professional documents, where required at an appropriate stage of recruitment;
  • account credentials and portal activity where you create a candidate account; and
  • information required for appropriate background, qualification, reference, work-eligibility or professional-status checks, where relevant and permitted by law.

Please do not provide sensitive personal data unless it has been specifically requested.

Where information concerning health, disability, criminal records, biometric identifiers or other sensitive matters is required, we will process it only where necessary, lawful and subject to appropriate safeguards.

3. How we obtain your information

We may obtain personal data:

  • directly from you;
  • from a recruitment agency, employee or other person who refers you;
  • from referees identified by you;
  • from former employers, educational institutions and professional bodies;
  • from background-screening or verification providers;
  • from publicly available professional sources; and
  • from athGADLANG entities, hiring clients and relevant governmental or regulatory authorities, where lawful.

Where you provide personal data relating to a referee or another person, you should ensure that the person is aware that their information may be shared with us for recruitment purposes.

4. Why we use your personal data

We may use your personal data to:

  • receive and administer your application;
  • assess your qualifications, experience, skills, suitability and eligibility for a role;
  • communicate with you and arrange interviews or assessments;
  • verify information provided in your application;
  • obtain references and conduct appropriate pre-employment checks;
  • assess immigration, residency and work-authorisation requirements;
  • determine proposed employment terms and prepare an offer;
  • manage the recruitment and placement process;
  • maintain appropriate records of recruitment decisions;
  • respond to enquiries, complaints and legal claims;
  • protect the security and integrity of our systems and recruitment processes;
  • comply with legal, regulatory and professional obligations;
  • improve our recruitment processes and careers portal; and
  • consider you for other suitable roles where you have agreed to this or where otherwise permitted by applicable law.

If your application is successful, relevant personal data will become part of your personnel record and will thereafter be processed in accordance with the applicable employee privacy arrangements.

5. Our legal basis for processing

Depending on the purpose and applicable law, we process personal data where:

  • it is necessary to take steps at your request before entering into an employment contract;
  • it is necessary for our legitimate interests, or those of a hiring client, in recruiting and selecting suitable personnel;
  • it is necessary to comply with legal, regulatory, immigration, employment or professional obligations;
  • it is necessary to establish, exercise or defend legal claims;
  • you have provided consent for a specific purpose; or
  • another lawful basis is available under applicable law.

Where we rely on legitimate interests, these may include managing recruitment, verifying candidate suitability, protecting our business and clients, maintaining recruitment records and improving our recruitment processes.

Where we rely on your consent, you may withdraw it at any time. Withdrawal will not affect processing already carried out lawfully before the withdrawal.

Consent to retain your profile for future opportunities is optional and will not affect the assessment of your application for a current vacancy.

6. Information required to process your application

Certain information may be required to assess your application, verify your identity or eligibility, comply with legal requirements or prepare an employment offer.

Required information will ordinarily be identified in the application process.

Where required information is not provided, we may be unable to assess or progress your application. Other information is optional and not providing it will not ordinarily affect your application unless it is necessary for the relevant role.

Candidates are responsible for ensuring that information submitted during the recruitment process is accurate, current and not misleading. athGADLANG reserves the right to withdraw consideration or terminate the recruitment process where materially inaccurate information is identified.

7. Verification and background checks

Where relevant to the nature and seniority of the role, and permitted by applicable law, we may verify:

  • your identity and eligibility to work;
  • your employment history;
  • your academic and professional qualifications;
  • your professional licences and memberships;
  • references;
  • sanctions or regulatory status; and
  • other information materially relevant to the position.

Checks will be conducted at an appropriate stage of the recruitment process and with your consent where consent is legally required.

We will not conduct checks that are excessive or unrelated to the requirements and risks of the position.

8. Who may receive your personal data

Your personal data may be disclosed, on a need-to-know basis, to:

  • authorised recruitment, human resources, management, legal, compliance, IT and administrative personnel;
  • other athGADLANG entities involved in the recruitment, employment or provision of shared services;
  • the relevant hiring client where we are recruiting or proposing personnel for a client;
  • recruitment-platform, cloud-hosting, communications, assessment and background-screening providers;
  • recruitment agencies, professional advisers, auditors and insurers;
  • immigration, labour, judicial, law-enforcement, regulatory and other governmental authorities where required or permitted by law; and
  • a prospective buyer, successor or adviser in connection with a merger, restructuring or transfer of all or part of our business, subject to appropriate confidentiality arrangements.

Where a client is to receive your identifiable CV or application, we will ordinarily inform you of the client’s identity before disclosure unless the identity has already been stated in the vacancy or there is a lawful and justified reason for maintaining confidentiality at that stage.

Where you apply for a role or otherwise express interest in a position, you authorise athGADLANG to share your CV, profile and recruitment-related information with the relevant hiring client for the purpose of evaluating your suitability for employment or engagement opportunities.

We do not sell candidate personal data or use it for third-party advertising.

9. International transfers

athGADLANG operates and supports recruitment activities across a number of jurisdictions. Our service providers may also host or process personal data in other countries.

Where personal data is transferred outside the country in which it was collected, we will use a transfer mechanism permitted under the applicable law. Depending on the circumstances, this may include:

  • transfer to a country recognised as providing an adequate level of protection;
  • appropriate contractual safeguards;
  • binding common rules or similar approved arrangements;
  • a transfer necessary for a permitted legal purpose; or
  • explicit consent where reliance on consent is lawful and appropriate.

We will apply reasonable technical, organisational and contractual safeguards to protect transferred information.

10. Recruitment technology and automated processing

We may use recruitment technology to receive applications, organise candidate records, parse CV information, identify qualifications or skills and assist authorised recruitment personnel in reviewing applications.

Recruitment decisions are made or reviewed by authorised personnel and are not based solely on automated processing that produces legal or similarly significant effects.

If we introduce a process involving solely automated decision-making that significantly affects candidates, we will provide any additional information and protections required by applicable law.

11. How long we retain your personal data

We may retain candidate profiles and recruitment-related information for so long as reasonably necessary to consider individuals for current or future opportunities, maintain appropriate recruitment records, comply with legal, regulatory and contractual obligations, and establish, exercise or defend legal claims. Personal data that is no longer required for these purposes will be securely deleted, anonymised or archived where continued retention is required by law.

12. How we protect your personal data

We maintain reasonable and proportionate technical and organisational measures designed to protect personal data against unauthorised access, use, disclosure, alteration, loss or destruction.

These measures may include role-based access controls, authentication, secure transmission and storage measures, confidentiality obligations, system monitoring, staff awareness measures, supplier controls and security-incident procedures.

No electronic system can be guaranteed to be completely secure. Candidates should therefore use the careers portal and approved communication channels rather than sending unnecessary sensitive information through unsecured means.

13. Your rights

Subject to the law applicable to the relevant processing and any permitted exceptions, you may have the right to:

  • be informed about how your personal data is processed;
  • request access to your personal data;
  • request a copy of your personal data in an appropriate format;
  • request correction or completion of inaccurate or incomplete information;
  • request deletion or destruction of your personal data;
  • request restriction, suspension or cessation of certain processing;
  • object to processing based on legitimate interests;
  • withdraw consent where processing is based on consent;
  • request data portability, where applicable;
  • request human review of certain automated decisions; and
  • lodge a complaint with the data protection authority having jurisdiction over the relevant processing.

These rights are not absolute. We may retain or continue to process certain information where required or permitted by law, including where necessary to establish, exercise or defend legal claims.

14. Candidates under 18

Our careers portal is not generally intended for individuals under 18 unless a particular internship, training or similar programme expressly permits applications from younger candidates and applicable legal requirements have been satisfied.

15. Cookies and portal information

Our careers portal may use cookies and similar technologies for authentication, security, preferences, analytics and portal operation.

16. Recruitment fraud

athGADLANG will never ask candidates to pay a fee as part of its recruitment process.

17. Changes to this notice

We may update this notice to reflect changes in our recruitment activities, systems or legal requirements.

The “Last updated” date at the beginning of this notice identifies the current version. Material changes may also be communicated through the Careers portal or by other appropriate means.
